Il cod. Canon. Misc. 262 della Bodleian Library di Oxford conserva una miscellanea di Giacomo della Marca (1393-1476) di tema economico. Il testo, che si compone di una prima sezione sulle restituzioni e di una seconda sull’usura, attualizza la materia giuridica secondo criteri comuni alle altre raccolte del predicatore. Attraverso un confronto con le argomentazioni del Directorium Iuris di Pietro Quesvel, è possibile ritenere che la seconda sezione della miscellanea stia alla base della voce sull’usura del Campus Florum e che sia probabilmente indipendente dal Compendium Theologie. Un ruolo decisivo nella sua trasmissione è rivestito dal copista, che sceglie di creare una breve raccolta attraverso l’accostamento degli appunti intermedi. Al termine del contributo si riporta la trascrizione della sezione sull’usura.
Abstract in English
The Cod. Canon. Misc. 262 in the Bodleian Library, Oxford, preserves an economic miscellany by James of the Marches (1393-1476). The text, consisting of a first section on restitution and a second on usury, updates the legal subject matter according to criteria common to the Observant friar's other collections. Through a comparison with Peter Quesvel’s Directorium Iuris, we can establish that the second section of the miscellanea underlies the composition of the lemma on usury in the Campus Florum, as well as being most likely independent of the Compendium Theologie. Therefore, the copyist plays an important role in the transmission, choosing to create a short collection by combining two excerpts of intermediate material. A transcription of the usury section of the miscellany is given at the end of the contribution.
