Abstract

Since the Italian Criminal Code’s entry into force, the offense of misconduct in public office (Art. 323 C.C.), in each own version, has always punished a multifaceted category of wrongdoings. Its recent – and probably beyond the law maker’s intentions – repealing (Law n. 114/2024) affects the “abuse of power”, too, so that now a large amount of retaliatory public malfeasances may not be punished anymore. This Work deals with this problematic “overreach”, describing the role of the abuse of power within Art. 323 C.C., analyzing the failed attempt to submit Law n. 114/2024 to constitutional review and, finally, sketching some hints in case of future, possible law reforms.
