Abstract

The theme of the relationship between violence and criminal law forces the criminalist to question the very foundations of the idea of punishing and to move from a still statist vision focused on punishing by violence to a personalist vision based instead on the idea that there can be another way of punishing, a punishing first and foremost in freedom.
