Abstract

The author focuses on the articles of the Spanish Constitution of 1812 which established that the holders of offices working for the Crown could not sit in Parliament. Through these determinations, however, the Spanish constituents did not intend to affirm the principle of separation of powers, and in particular of separation of the legislature from the executive, because they distrusted the latter. Rather they wanted to lay the foundations for a modern relationship between government and administration, believing that without active support of the latter no constitutional government could stand against the machinations of the reaction.
