L’ispirazione giuridica in Dicey, momento più elevato del pensiero dell’Autore, rap- presenta il punto di convergenza tra gli aspetti della tradizione di common law e i forti elementi innovatori che l’opera Introduction to the study of the Law of the Constitution pone in piena evidenza. Da un lato infatti non si può negare che Dicey sia prima di tutto un common lawyer, un operatore pratico del diritto che, in modo non dissimile dai suoi predecessori, ha utilizzato un approccio al discorso giuridico dal taglio assolutamente pragmatico, come meglio emergerà nel corso della trattazione. Tuttavia, allo stesso tempo, egli è stato forse il primo, tra i suoi contemporanei, ad adottare un metodo sistematico per lo studio del diritto costituzionale, legato alla necessità di superamento di un’ottica tesa a studiare il diritto in termini statici.
