The article comprises two parts: the first is developed by way of a comparison between the con- tents of the constitutional project of the Neapolitan Republic of 1799, drawn up by jurist Mario Pagano, and those of the French Constitution of 1795, reference point of all the constitutions of the Italian Republican Triennium 1796-1799; in the second part we find the different interpretations that historiography, from Cuoco up to the present day, has elaborated on the Pagano’s constitutional project.
