The essay reconstructs little-known aspects of Filippo Vassalli’s constitutional thought, drawing upon archival material. As demonstrated by the analyzed documents, Vassalli’s commitment during the democratic transition was more significant than previously established, culminating in the important legal advice provided twice for the Allies on the powers of the Constituent Assembly. These opinions can be placed alongside the notes and observations on the powers of the provisional government’s Cabinet, found among his papers. Overall, the essay reveals a knowledgeable jurist capable of advancing interesting arguments in defence of the powers of the Constituent Assembly. These arguments, according to the essay’s author assessment, played a role, along with other considerations, in leading the government to modify its decisions. This is therefore an essential piece for reconstructing the contribution made by Italian jurists during the troubled events of 1944-1945.
