Il diritto e le necessità dei beni culturali / Law and cultural heritage needs

Abstract

Ogni analisi volta a verificare quale contributo il diritto possa apportare alle necessità dei beni culturali non autorizza risposte facili. D’altro canto, non si può dire che il sistema dei beni culturali abbia sofferto di silenzi normativi. Il “diritto dei beni culturali” è, semmai, la risultante di numerosi interventi, con i quali il tronco sia funzionale sia ordinamentale del settore è stato sottoposto a reiterate modifiche. Mentre la “tutela” ha continuato a giovarsi di uno statuto risalente, la “valorizzazione” ha stentato a trovare una propria identità. La stessa categoria dei “beni culturali” ha risentito di queste risistemazioni e degli sforzi per rendere compatibili tutela e valorizzazione. Non di meno, vi è “qualche cosa” che non è stato fatto. Un elenco delle omissioni non è possibile, nel contesto di quelle che sono brevi considerazioni. Tuttavia, un dato si impone ed è quello che conduce all’apparato ministeriale e al suo ruolo di “centro” di governo del settore.

Any analysis about what law can do in order to meet cultural heritage needs is far from being easy. For sure, the Italian system never experienced a lack of legislative or governmental initiatives. On the contrary, the so-called "cultural heritage law" has been facing a sequence of changes due to regulations, enacted one after the other. While "preservation" succeeded in keeping its own dated and tested statute, cultural heritage "enhancement" hardly found its recognition nor took advantage of a functional system. The notion itself of cultural heritage suffered from the attempts made to find the way to its enhancement and to make it consistent with its preservation. To overcome the difficulties that arise from this, it seems more useful looking at what regulations never changed so far. A perspective which leads, among the others, to the role played by the main bureaucratic apparatus in charge for cultural sector, that is the Ministry for Cultural Heritage and Activities.
